Imagine you are on the witness stand.
The opposing counsel presents a document your team created with artificial intelligence assistance. They ask a simple question. “Can you explain how this conclusion was reached?” Your silence is your answer. As a licensed professional, this is a scenario you cannot afford. If AI is part of your professional workflow, then human oversight must be embedded within that same workflow.
This is not a suggestion. It is the new, non-negotiable standard of care.
The Risk: Undocumented and Indefensible Actions
The primary risk of artificial intelligence in a professional setting is not error. It is opacity. When an AI tool generates an output without a corresponding record of how, why, and when, you are left with an outcome you cannot defend. AI’s presence in your workflow automatically introduces this risk. Every undocumented action is a potential liability. Your professional duty is to eliminate that liability through structured governance.

Effective AI governance is not a final review step that you bolt on at the end of a process. It is a series of checkpoints embedded directly into the workflow itself. For every stage of an AI-assisted task, from input to final output, there must be a corresponding, documented moment of human oversight. Use these questions to determine if your current workflow would hold up under professional or legal scrutiny.
Can you identify every AI touchpoint in your workflow?
Is there a permanent log of who prompted the AI and when?
Is the AI’s direct, unedited output saved for the record?
Is the final human review and sign-off explicitly documented?
Can you produce this entire record within 24 hours for an audit?
If the answer to any of these questions is no, your workflow is not defensible. This is the new baseline for peer accountability.

The Governance Shift
The standards of professional diligence from the American Bar Association or the American Medical Association do not disappear when you use a new tool. You are still expected to supervise, validate, and take full responsibility for the work product. Viewing oversight as a burden is a critical error. Viewing it as the very structure that protects your credibility is the essential governance shift.
